These Terms & Conditions (the “Terms”) constitute a legally binding agreement between you (“you,” “your,” or the “user”) and Sergg Device, together with its owners, officers, members, employees, affiliates, successors, and assigns (“Sergg,” “we,” “us,” or “our”), governing your access to and use of the serggdevice.com website and any subdomains, mobile experiences, content, tools, configurators, and features made available through it (collectively, the “Site”), and your purchase or use of any products offered through it (each a “Product”). You are solely responsible for using each Product safely, hygienically, lawfully, and in a manner appropriate to your own body and circumstances.

All content on the Site — including descriptions, sizing tools, configurators, blog or educational material, and any interactive feature — is provided for general informational and entertainment purposes only and does not constitute medical, health, legal, or professional advice. Any sizing suggestion, fit estimate, configuration recommendation, or similar output generated by tools on the Site is an approximation for convenience only, is based on information you provide, and is not a guarantee of fit, comfort, suitability, or result. The patent reflects the novelty of the design and does not constitute any representation regarding efficacy, performance, or results.
Nothing on the Site grants, by implication or otherwise, any license or right to use any Content or intellectual property without our prior written permission. You may not copy, reproduce, republish, distribute, modify, reverse-engineer, create derivative works from, frame, scrape, data-mine, or otherwise exploit any portion of the Site, the Content, or the Products except as expressly authorized in writing. We reserve all rights not expressly granted.
6. License to Use the Site
Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Site for your own personal, non-commercial purposes. This license terminates automatically if you breach these Terms, and we may suspend or revoke it at any time in our sole discretion.
7. Acceptable Use & Prohibited Conduct
You agree not to, and not to attempt to or authorize any third party to: (a) use the Site or any Product for any unlawful, fraudulent, infringing, or harmful purpose; (b) resell, rent, distribute, or commercially exploit any Product or Content without our prior written authorization; (c) access or use the Site by automated means, or introduce any malware, virus, or harmful code; (d) interfere with, disrupt, probe, or circumvent the security or operation of the Site; (e) impersonate any person or misrepresent your affiliation, age, or identity; (f) submit false, inaccurate, or misleading information, including in any order, account, review, or chargeback; (g) infringe, misappropriate, or violate the intellectual-property, privacy, or other rights of Sergg or any third party; or (h) use the Site or Products in any manner that could damage, disable, or impair Sergg or interfere with any other party’s use. We may investigate and take any action we deem appropriate, including refusing service, terminating accounts, reversing transactions, and reporting conduct to law-enforcement or other authorities.
8. Accounts & Security
If you create an account, you are responsible for maintaining the confidentiality of your credentials and for all activity occurring under your account. You agree to provide accurate and complete information and to keep it current. You must notify us promptly of any unauthorized use or suspected breach. We are not liable for any loss arising from unauthorized use of your account, and we may suspend or terminate accounts at our discretion.
9. Orders, Pricing, Payment & Fraud Prevention
All orders are offers to purchase and are subject to our acceptance. We may, in our sole discretion and without liability, refuse, limit, cancel, or require additional verification for any order — including where we suspect error, fraud, unauthorized payment, reseller activity, or a breach of these Terms — even after an order confirmation has been sent. Prices, descriptions, availability, and promotions are subject to change without notice and may contain inadvertent errors, which we reserve the right to correct. You represent that you are authorized to use any payment method you provide and that all information you supply is accurate. You agree to pay all charges, applicable taxes, and shipping fees. Title and risk of loss for physical Products pass to you upon our delivery to the carrier. You agree not to initiate any fraudulent, abusive, or unwarranted chargeback; we reserve the right to dispute and recover on improper chargebacks, including associated costs and fees.
10. Shipping, Discretion & Risk of Loss
We ship within the United States only, using discreet packaging where offered. Delivery dates and times are estimates only and are not guaranteed. We are not responsible for delays, losses, or damage caused by carriers, incorrect addresses provided by you, or events beyond our reasonable control. You are responsible for ensuring receipt of adult Products is lawful at your delivery address.
11. Returns, Refunds & Restocking
You may return any Product, opened or unopened, within 14 days of receiving your order, for any reason, for a refund of the purchase price less a 35% restocking fee. To start a return, contact us within the 14-day window with your order number as proof of purchase, and we will provide return instructions; your refund is issued to the original payment method once the returned Product is received. If a Product arrives defective or damaged, our 14-Day Arrival Guarantee covers it with a free replacement at no charge and no restocking fee. This Section does not limit any rights that cannot be waived under applicable law.
12. Limited Warranty
We warrant only that, at the time of delivery, a Product will be free from material manufacturing defects under normal, intended personal use for the limited warranty period (if any) stated in the materials accompanying the Product or on the Site. This limited warranty is the sole and exclusive warranty we provide, extends only to the original purchaser, and is non-transferable. It does not cover normal wear, cosmetic changes, or any damage, malfunction, or condition resulting from misuse, abuse, accident, alteration, improper cleaning or storage, use of unauthorized accessories or accessory combinations, failure to follow instructions, or use contrary to the Product’s intended purpose. Your sole and exclusive remedy under this limited warranty is, at our option and to the extent permitted by law, repair, replacement, or refund of the purchase price of the affected Product.
Sergg Loyalty Replacement Program. As a separate, discretionary courtesy beyond the limited warranty above, we may offer original purchasers the ability to obtain replacement components at a reduced Loyalty price. This program is provided for personal ownership only and is intended for the original purchaser’s own Device. When filing a claim you confirm that you are the original, rightful owner of the order associated with the claim. We may require proof of purchase, verify ownership, and may decline, delay, or reverse claims, cap the number of replacements per customer, order, or component, or limit, suspend, or modify the program, where we reasonably believe a claim is fraudulent, abusive, or intended for resale, or where we detect resale, sharing of order credentials, or other activity inconsistent with personal ownership or these Terms. Replacements generally do not require you to return the original item; however, we reserve the right to require, as a condition of approving any replacement — including for repeat or high-volume claims — that the original item first be returned to us with return shipping at our expense, and to decline, delay, or hold a replacement until any requested item is received and inspected. The Loyalty price is a courtesy discount and not a warranty entitlement; nothing in this program enlarges the limited warranty or guarantees future availability.
13. Disclaimer of Warranties
EXCEPT FOR THE LIMITED WARRANTY EXPRESSLY STATED IN SECTION 12, AND TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SITE, ALL CONTENT, AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE FULLEST EXTENT PERMITTED BY LAW, WE SPECIFICALLY DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING, USAGE, OR TRADE PRACTICE. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL SERGG OR ITS OWNERS, OFFICERS, MEMBERS, EMPLOYEES, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, OR FOR ANY PERSONAL INJURY, EMOTIONAL DISTRESS, OR PROPERTY DAMAGE, ARISING OUT OF OR RELATING TO THE SITE, THE CONTENT, ANY PRODUCT, OR THESE TERMS, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, WARRANTY, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF SERGG AND THE PARTIES LISTED ABOVE FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SITE, THE CONTENT, ANY PRODUCT, OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU ACTUALLY PAID TO US FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US$100). THE FOREGOING LIMITATIONS APPLY TO THE FULLEST EXTENT PERMITTED BY LAW. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OR THE EXCLUSION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU; NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW, INCLUDING LIABILITY FOR FRAUD OR FOR DEATH OR PERSONAL INJURY CAUSED BY OUR PROVEN GROSS NEGLIGENCE OR WILLFUL MISCONDUCT WHERE SUCH LIABILITY MAY NOT LAWFULLY BE LIMITED. YOU AGREE THAT THESE LIMITATIONS ARE A FUNDAMENTAL BASIS OF THE BARGAIN BETWEEN US AND WILL SURVIVE EVEN IF ANY REMEDY FAILS OF ITS ESSENTIAL PURPOSE.
15. Indemnification
To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless Sergg and its owners, officers, members, employees, agents, suppliers, and affiliates from and against any and all claims, demands, actions, liabilities, damages, losses, judgments, fines, penalties, costs, and expenses (including reasonable attorneys’ fees and costs) arising out of or relating to: (a) your access to or use of the Site, Content, or any Product; (b) your misuse of any Product or failure to follow instructions, warnings, or safe-use requirements; (c) your violation of these Terms or any applicable law; (d) your violation of the rights of any third party; or (e) any content or information you submit. We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and you agree to cooperate with our defense. This Section survives termination of these Terms.
16. Third-Party Links & Services
The Site may contain links to or integrations with third-party websites, payment processors, or services that we do not own or control. We provide these for convenience only and are not responsible for the content, policies, security, or practices of any third party. Your dealings with any third party are solely between you and that third party.
17. Privacy
Your use of the Site is also governed by our Privacy Policy, which describes how we collect, use, and protect information. By using the Site, you consent to the practices described in the Privacy Policy.
18. Dispute Resolution — Binding Arbitration & Class-Action Waiver
Please read this Section carefully — it affects how disputes are resolved and, in many cases, requires individual arbitration instead of court litigation or a jury trial.
(a) Informal resolution first. Before commencing any formal proceeding, you agree to first contact us and provide a brief written description of the dispute and your contact information, and to attempt in good faith to resolve the dispute informally for at least sixty (60) days. Many concerns can be resolved quickly this way.
(b) Agreement to arbitrate. To the fullest extent permitted by applicable law, and except as provided below, you and Sergg agree that any dispute, claim, or controversy arising out of or relating to the Site, the Content, any Product, or these Terms — including their existence, validity, interpretation, breach, or termination — that is not resolved informally will be resolved by final and binding individual arbitration, rather than in court, administered under the rules of a recognized, neutral arbitration provider then in effect, as modified by these Terms. The arbitration shall be conducted by a single neutral arbitrator. Judgment on the award may be entered in any court of competent jurisdiction. The Federal Arbitration Act governs the interpretation and enforcement of this Section.
(c) Class-action and jury-trial waiver. To the fullest extent permitted by applicable law, you and Sergg agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person’s claims and may not preside over any form of class or representative proceeding. You and Sergg are each waiving the right to a trial by jury and the right to participate in a class action, to the extent permitted by law.
(d) Exceptions. Notwithstanding the above, either party may (i) bring an individual claim in a small-claims court for disputes within that court’s jurisdiction, and (ii) seek injunctive or other equitable relief in a court of competent jurisdiction to protect intellectual-property or proprietary rights. This Section does not require arbitration of any claim that, as a matter of law, cannot be subject to a pre-dispute arbitration agreement.
(e) Severability of this Section; consumer protections. If the class-action waiver in subsection (c) is found unenforceable as to a particular claim, that claim (and only that claim) shall be severed and proceed in court, while all other claims proceed in arbitration. If applicable law prohibits enforcement of any part of this Section against you as a consumer, that part shall not apply to you, and the dispute shall instead proceed as permitted by such law. Nothing in this Section, and nothing elsewhere in these Terms, requires that any aspect of the resolution of a dispute be kept confidential, and nothing waives any right or protection that applicable law makes non-waivable.
19. Governing Law & Venue
These Terms and any dispute arising out of or relating to them, the Site, the Content, or any Product are governed by the laws of the State of Nevada and applicable United States federal law, without regard to conflict-of-laws principles. Subject to the arbitration provisions in Section 18, and to any mandatory protections that applicable law affords you as a consumer, the exclusive venue for any permitted court proceeding shall be the state and federal courts located in the State of Nevada, and you consent to the personal jurisdiction of those courts — provided that nothing in this Section deprives you of the benefit of any mandatory provision of the consumer-protection law of your home jurisdiction that cannot be waived by agreement.
20. Time Limitation on Claims
To the fullest extent permitted by applicable law, any claim or cause of action arising out of or relating to the Site, the Content, or any Product must be commenced within one (1) year after the claim or cause of action accrues; otherwise, that claim or cause of action is permanently barred. Where applicable law does not permit a one-year limitation, the shortest period permitted by that law shall apply.
21. Force Majeure
We will not be liable or responsible for any failure or delay in performance caused by events beyond our reasonable control, including acts of God, natural disasters, epidemics or pandemics, war, terrorism, civil unrest, governmental action, labor disputes, carrier or supplier failures, payment-processor or internet outages, or other force-majeure events.
22. Changes to These Terms or the Site
We may modify these Terms at any time by posting the revised version on the Site and updating the “Last updated” date. Changes are effective when posted. Your continued access to the Site or purchase or use of any Product after changes are posted constitutes your acceptance of the revised Terms. We may also modify, suspend, or discontinue any part of the Site or any Product at any time without notice or liability.
23. Assignment
You may not assign or transfer these Terms or any rights or obligations under them without our prior written consent. We may freely assign or transfer these Terms, in whole or in part, without restriction. These Terms bind and benefit the parties and their permitted successors and assigns.
24. Severability, Waiver & Entire Agreement
If any provision of these Terms is held invalid, unlawful, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or if it cannot be so modified, severed, and the remaining provisions shall continue in full force and effect. Our failure to enforce any provision is not a waiver of our right to do so later. These Terms, together with the Privacy Policy and any additional terms or policies expressly incorporated by reference, constitute the entire agreement between you and Sergg regarding the Site and the Products and supersede all prior or contemporaneous understandings. Section headings are for convenience only and do not affect interpretation. These Terms do not create any third-party beneficiary rights except for the indemnified parties named above.

How To Measure
For the most accurate fit, measure when fully erect. For length, press a ruler gently to the base and measure along the top to the tip. For girth, wrap a soft tape measure or a strip of string around the thickest part, then measure it against a ruler. Enter your length and girth into the Fit Lab above to see your recommended chamber.
A note on elasticity. Cylinder 225 runs 7″ deep with Adapter 1, and erect tissue is wonderfully elastic — how much it lengthens under vacuum is simply different on every man. A man measuring 6″ can absolutely use the 225: a generous expander will fill it like it was made for him, while another man at the same 6″ keeps comfortable breathing room — both are winning. The Fit Lab simply leans toward the Cylinder XL225 the closer you get to 6″, because its 10″ of internal length hands a strong expander unlimited road.

What Science Actually Says About Size
Most men quietly believe the average erect length is six inches. The largest clinical review ever conducted — 15,521 men, measured by health professionals and published in BJU International — says otherwise. The real numbers are friendlier than the locker-room legend.
A few more truths worth knowing. The average flaccid length is about 3.6″ — and flaccid size is a famously poor predictor of erect size, so the man you are at rest says little about the man you become. Perception research found that most men overestimate the average by nearly an inch, which means a great many men walking around feeling “below average” are, in fact, standing right on it — or above. And partners? In one study, 85% of women reported being satisfied with their partner’s size; in another, 77% said length was unimportant to them.
